“No business is currently licensed to sell adult-use cannabis in New York State. Selling any item or making a donation and then offering a customer a bag of untested cannabis does indeed count as a sale under New York’s Cannabis Law,” said Tremaine Wright, chair of the New York Cannabis Control Board, in a press release. “You need a license to sell cannabis in New York. Licensed sales and a regulated marketplace are the only way for New York customers to be assured that the cannabis products they buy have been tested and tracked from seed to sale. tested puts lives at risk.”

The 52 stores in New York City incorrectly describe their business as legal cannabis dispensaries, but they are not licensed by New York State, officials say. Stores sell untested products that put public health at risk, the New York State Office of Cannabis Management reports.

The letters also told the companies that if they did not stop, they could be permanently banned from receiving cannabis licenses in New York State.

“These stores pretend to be licensed and regulated businesses, but they are not. They don’t create opportunities, they create confusion. New Yorkers think they’re buying a tested, high-quality product when they’re not,” said Office of Cannabis Management Executive Director Chris Alexander. “Not only are these stores operating in violation of New York’s cannabis law, they are also in violation of state tax and several municipal laws.
