Emily Yu, who ran an illegal Airbnb from her home in North Vancouver, was sentenced earlier this month to 30 days and a year of probation following a guilty verdict for disobeying a court order.

He is also forbidden to be within 100 meters of the townhouse.

Yu was arrested in 2020 after padlocking the door of her former home, preventing potential buyers from viewing the property.

She lost ownership of the property after failing to repay the more than $50,000 she owed in legal fees following the court battle she lost against her strata, which began after she refused to quit to use his property as an inn.

“I find that Ms. Yu’s continued defiance has been so willful and deliberate that a lengthy period of incarceration is necessary to meet the need for general and specific denunciation and deterrence,” Provincial Court Judge Joanne Challenger said. in his motives.

Throughout the proceedings, the Supreme Court document suggests that Yu repeatedly forgot to silence his cell phone, claimed not to speak English and suggested that the documents were “forgeries” and that the witnesses were “imposters”.

“I find the fantastic theories and unsubstantiated suggestions made during the trial before me, including her assertion that she is still the rightful owner of the townhouse, to have been the product of the mind of a desperate person who probably has an unhealthy personality construct,” explained the judge.

The judge also did not accept claims that Yu’s behavior was due to him being under the influence.

“Ms. Yu suggested that she was hungover or inebriated and that a health condition had ‘flared up’ which, in concert, led to poor judgment or understanding. at the time of the offense However, she was inconsistent as to whether she was hungover or intoxicated and none of the witnesses present at the time of the offense suggested that she was under the influence of alcohol. The medical letters submitted do not mention any medical condition that could have affected his judgment. I do not accept his submissions in this regard.

The maximum penalty for disobeying a court order without lawful excuse contrary to s. 127(1) of the Criminal Code is imprisonment for six months or a fine of $5,000.00.
