Man arrested after family dispute turned deadly

POTTAWATOMIE COUNTY, Okla. (KFOR) – A Pottawatomie County man is facing first-degree murder charges after he allegedly killed his mother’s boyfriend outside a Prague home.

Court documents filed this week reveal Joseph Maher was sitting inside his motorhome at the north end of his mother’s driveway on Summer Trail Road when his mother and boyfriend Brian Sorrell pulled up. approached him. The documents say the couple told Maher they wanted him to leave because of “his drug use.”

Maher’s mother told police that her son “became angry after learning that the couple had locked their home and that he could not enter while they were away,” according to court records.

As the row between Maher and Surrell escalated, court documents detail Maher’s mother telling police she went to sit in her car. From there, she reportedly said she saw her son “reach for the gun in the holster, then heard a gunshot.”

Court documents show Surrell “ran away from the trailer screaming that he had been shot and jumped into the passenger seat of the vehicle.” Once inside the vehicle, he reportedly “started panting and fell outside to the ground”.

Maher’s mother called 911 according to court records, however, Surrell died before EMS arrived.

Court documents indicate that Maher allegedly told several stories to the police. During one of them, he claimed, “he passed out and doesn’t remember what happened” and “the gun just went off”.

Maher is now locked up in the Pottawatomie County Security Center. He is due to appear in court in mid-October.
